Why are people suing baby food manufacturers?

In 2019, a non-profit organization named Healthy Babies Bright Futures (HBBF) examined 168 brands of baby food for heavy metals that could alter a child’s developing brain. According to the HBBF’s study, nearly all 168 baby foods contained at least one type of heavy metal:

  • 95% contained Lead.
  • 75% contained Cadmium.
  • 73% contained Arsenic.
  • 32% contained Mercury.

Shortly after the study was published, a U.S. House Subcommittee requested internal documents from seven of the largest baby food brands in the country, including household names like Gerber. Then in 2021, the Subcommittee released a report supporting the HBBF’s findings, claiming that commercial baby foods contained “dangerous levels of arsenic, lead, mercury, and cadmium.”

Heavy metal exposure (particularly lead) has been linked to an increased risk of Autism Spectrum Disorder (ASD) in peer-reviewed medical journals for many years, dating as far back the late 1970s.

Baby Food Lawsuit FAQs

How much heavy metal exposure is considered dangerous to children's health?

Currently, the United States allows for up to 10 ppb arsenic, 5 ppb cadmium, 5 ppb lead, and 2 ppb mercury in bottled or municipal drinking water. Many brands of American baby food, however, contain FAR MORE heavy metals than the amounts allowed in our water.

Though heavy metal poisoning can cause major health problems in adults—including infertility and brain damage—babies and children are at a much higher risk of developing life-altering conditions if they’re exposed. Heavy metal poisoning in young children can lead to developmental delays, behavioral disorders, an increased risk of cancer, and several other effects.

Which baby food brands are most affected by heavy metal contamination?

Though heavy metals were found in 95% of the 168 baby food products tested by the HBBF, some brands may be more contaminated than others.

  • Beech-Nut has used ingredients that tested for up to 886.9 ppb lead.
  • Some of Happy BABY’s ready-to-eat foods contain up to 641 ppb lead.
  • Earth’s Best Organic has used ingredients with up to 309 ppb arsenic.
  • Gerber has used ingredients with up to 87 ppb cadmium & 48 ppb lead.

Most of these brands also DO NOT test for mercury, one of the most toxic heavy metals for young children to be exposed to.

How much can I expect to win for a Baby Food settlement?

Your settlement would depend on the monetary value of the damages your child has suffered, as well as other factors. Because settlement amounts heavily vary per case, and because this lawsuit is still relatively new, we can only provide an average range of settlements that plaintiffs are expected to win. Settlements for the Baby Food lawsuit are estimated to fall between $500,000 and $1.5 million per case.
